MARION—Crawford County Now has learned that Christian Gutierrez, 19, of Marion, is facing the death penalty for the murder of Charles Feliciano, 27, of Marion.
As reported by Crawford County Now, Gutierrez was arraigned Monday on five additional counts, including three counts of murder and two counts of felony assault.
Marion County Assistant District Attorney Jocelyn Stefancin told Marion County Court of Common Pleas Judge WT Edwards that the district attorney’s office believes evidence from the ongoing police investigation supports the state asks for a specification of the death penalty.
Gutierrez, who pleaded not guilty to all counts, remains incarcerated at the Marion Multi-County Correctional Facility.
After the replacement indictment with the death penalty specification was issued by the grand jury, attorney James D. Owen, who represented Gutierrez, asked the judge to be removed from the case. .
Owen told the court he couldn’t devote the time necessary to prepare a death penalty case.
Judge Edwards granted the motion and then contacted the Ohio Public Defender’s Office to request a new attorney for Gutierrez.
A preliminary hearing is scheduled for May 26. A new trial date will be set shortly.
